ParsecDeepSky Terms of use

  1. はじめに

    Please read the following before using ParsecDeepSky (hereinafter referred to as the app). These terms of use may be updated or changed at our discretion.

    • By downloading and using the app, users are deemed to have agreed to these Terms of Use.

  2. App Usage Premission

    Users may use the app provided that they comply with these terms fo use.

  3. Change the app content

    We may change all or part of the content of the app a t our convenience.

  4. Fees
    • Users may use all of the features of the App without paying any fees for up to 30 days from the date of downloading and first launching the App. However, users shall bear all communication charges and other costs associated with the use of the App.
    • Users who wish to continue using the app can purchase a subscription, which allows them to use the app for a specific period of time under certain conditions. The subscription fee will be charged to the Apple ID used to purchase the app.
    • The subscription types, periods and prices are as follows:
      • Monthly plan: 1 month from the date of purchase (from the date of purchase to the day before the same date of the following month)
      • Annual plan: 1 year from the date of purchase (from the date of purchase until the day before the same date of the same month of the following year)
    • Your subscription will automatically renew at the end of the validity period unless you cancel it.
    • You can stop the auto-renewing subscription by canceling your subscription through your Apple ID settings at least 24 hours before midnight on the last day of the validity period.
    • Once you subscribe, you cannot refuse to pay the fee for any reason, including not using the app. Well, even if you cancel during the subscription period, the fee you have already paid will not be refunded.

  5. Prohibited acts

    When using the app, users are prohibited from engaging in the following acts.

    • Copying, disassembling, adding to, editing, deleting, modifying, altering, publicly transmitting, adapting, or otherwise exploiting the App.
    • Analyzing the App, including reverse engineering, decompiling, disassembling, etc.
    • Transferring, licensing, setting as security, or otherwise disposing of the App, whether for a fee or free of charge.
    • Transferring, licensing, setting as security, or otherwise disposing of the right to use the App, whether for a fee or free of charge.
    • Infringing the property rights, intellectual property rights, privacy rights, or interests of us or any third party, or engaging in any acts that may do so.。
    • Defaming us or any third party, or damaging their reputation or credibility, or engaging in any acts that may do so.
    • Violating public order and morals, or engaging in any acts that may do so.
    • Using the App for illegal purposes.
    • Creating harmful programs, such as computer viruses, in relation to the App.
    • Engaging in any acts that may interfere with the operation of the App and us.
    • Engaging in any other acts that we deem inappropriate.

    If a user commits any of the prohibited acts listed above and causes damage to us, the user will be obligated to compensate us for such damage.

  6. Intellectual Property Rights

    The app and the content, design, layout, and all intellectual property rights, including copyrights and trademarks, displayed within the app belong to us or the content providers and are protected by relevant intellectual property laws. However, all intellectual property rights to images taken through the app belong to the user.

    Users have the right to freely use the images they take for any purpose, including commercial use. We do not claim any rights to the images they take.

  7. Cancellation or interruption of the app

    If any of the following situations occur, we may, at our discretion, suspend, stop or interrupt distribution of the App, or take other measures (hereinafter referred to as "Suspension, etc.") without prior notice to Users.

    • In the event of a natural disaster, riot, power outage, or other emergency.
    • When performing maintenance and inspection of all content, text, images, data, software, information and other materials (hereinafter referred to as Content, etc.) displayed on the App.
    • If we determine that cancellation is necessary.

  8. Quitting the app

    We reserve the right to terminate distribution of the app at any time, and shall not be liable for any damages incurred by users as a result of such termination.

  9. Disclaimer

    We are not responsible for any guarantee of operation of this application, or for its suitability, usefulness, accuracy, reliability, etc. for a specific purpose of use by the user.

    We shall not be held responsible for any damages incurred by users as a result of using or being unable to use the app, except in cases where such damages are due to our willful misconduct or gross negligence. We shall not be held responsible for any disputes or damages incurred by users as a result of using the app.

  10. Compensation

    If the Company incurs damages as a result of a user's violation of these Terms of Use, the user shall be liable to compensate the Company for such damages.

  11. Changes to Terms of Use

    We reserve the right to freely change these Terms of Use. If the user uses this app after these Terms of Use have been changed, the user will be deemed to have agreed to the changes to these Terms of Use. However, if the changes require the user's consent under law, the user's consent will be obtained in a manner specified by us.

  12. Governing Law, Jurisdiction

    Use of the app and the interpretation and application of these Terms of Use shall be governed by the laws of Japan. Any disputes relating to the app shall be submitted to the exclusive jurisdiction of the Kagoshima District Court as the court of first instance.
